Title services involve issuing title insurance, working with the seller and buyer to sign real estate and loan documents, providing notary services, and acting as the escrow agent who holds the deposits and disburses the proceeds when the deal is done. When someone speaks of “attending a closing,” they are talking about going to a title company to sign real estate and loan documents to close the deal. What is title insurance?
Title insurance is no different than other insurance products you may buy, for example, health or life insurance, renter’s insurance or homeowner insurance. It protects you against unexpected losses. In this case, it protects you against unexpected losses from a title defect. At closing, the title company issues the buyer a title insurance policy to fix an unexpected title defect. For example, if, after the closing, the buyer discovers a lien on the property that would cost $20,000 to remove, he would make a claim to his title insurance company. The insurance company would either pay the $20,000 to remove the lien or hire lawyers to challenge the lien’s validity on the buyer’s behalf. Regardless, you would pay nothing to have the defect fixed.
